Should I be separating Ma’aser from the money that my ex-husband sends me?

Question:

I got a get several months ago but the civil divorce hasn’t even been filed. I don’t currently have a paying job (I’m taking care of the kids) and my ex-husband has been transferring money to my bank account to cover my expenses. Whenever that amount runs out I let him know and he sends more money. Should I be separating Ma’aser from this money that he sends me? Is it considered income since we have a get?

Answer:

If it’s for child support or a specific expense, no. Otherwise, you should pay Ma’aser if the assumption is that your ex who is providing the money has no issue with it.
