Q. Can I swap the box of matzah I used for eruv chatzeiros from expensive to cheaper?

A. No. But you can make a new one after you eat the old one or discard it.

Q. My backyard opens into an alley and I want to make an eiruv with my Jewish neighbors so that we can carry into the alley and to each others backyards/houses. Do I need to rent from the non-Jewish neighbors? In Shulchan Aruch Siman 389 – חלון פתוח למבוי – it seems that it is not required since the main entrance is from the street, not the alley.

A. You are correct. In this case, there is no need to rent the rights of the area from the non-Jewish neighbors.

Q. I made an Eruv Chatzeros. For the Tzuras Hapesach, I have a string between two poles. Is it a problem if one pole is several (4-6) feet higher than the other pole, resulting in the string being on a visible slant?

If the angle of the slant is less than 45° it’s ok.

 

זה לשון אדה”ז בשולחנו שסב, יא: מהו צורת פתח קנה מכאן וקנה מכאן אפילו אחד רחוק מחבירו וקנה על גביהם. וכבר התקשו רבים בהבנת מילת “רחוק”, ויש שהציעו שנפל כאן טה”ד וצ”ל גבוה. ומקורם מהרא”ם בשו”ת מים עמוקים סימן כ”ה, מובא במג”א שם סקי”ח, וכן הגיה הגרע”א בדברי המג”א. וכן העתיקו הא”ר, פמ”ג, משנ”ב, כה”ח ועוד פוסקים.

אבל המעיין במקור הלכה זו בדברי הרא”ם גופא, ימצא שלא הכשיר בלחי אחד גבוה מהשני אלא כשקנה העליון אינו משופע (ראה שם מציאות הדברים), אבל במשופע לא הכשיר. אלא שכנ”ל, רוב האחרונים הכשירו בלחי גבוה בסתמא. ובזה נראה כמה מדוייק לשון רבינו דלעיל.

ובהגהת רע”א מחלק בין משופע הרבה לשאינו (הובא בשער הציון), וכ”כ בשו”ת ברית אברהם או”ח סימן ט”ז. ומקובל להכשיר עד 45 מעלות.
