Maaseh Shabbos with an Eiruv

 

Question:

Can I benefit from food brought for me on Shabbos since I don’t hold by the Eiruv?

 

Answer:

In a community which has a proper Eiruv sanctioned by the local Rabonim, you would be allowed to benefit after the fact, but you cannot tell him to do it for you, if you personally are of the opinion that this Eiruv is not valid. See here.

In general, is הוצאה subject to Maaseh Shabbos?

Also, does the Alter Rebbe hold like the Mishna Berura that if something is legitimately mutar but you don’t hold by it, it is not subject to Maaseh Shabbos?

 

Answer:

1. According to most opinions, Hotzaah is something that would have the Gezaira Bedieved if done. See here in the references as for the opinion of the Alter Rebbe.

2. What the Mishna Berura says is that if there is a doubt because of a argument in Halacha, Bedieved it’s Mutar since we don’t penalize. The A”R (and others) seem to hold that that applies only by an Issur Derabanan.
