Should I tell the damaged party who was the damager?
Question:
If one yid knows that a second did damage to a third and doesn’t want (and won’t) admit it, should/must he tell the damaged party who was the damager or should he not?
And would there be a difference if it’s in a Yeshiva (that one Bochur knows that a different Bochur broke something and doesn’t want to say, could/should the first bochur tell the hanhalah) when it’s not a specific person’s property rather ממון הקדש?
Answer:
Unless there will be a benefit to the damaged party, nothing should be said. Usually testimony from one person won’t be to any benefit, as the one that did the damage can still deny it. (Unless the damaged party would like to bring the one that did the damage to Beis Din and obligate him to swear on his denial).
