Is disinterring and re-burying allowed?

Someone who died in a NY hospital was deemed an apparent indigent person, no family or contacts. The family living in a different state found out a couple weeks later, after the deceased was buried due to the long delay, including legal issues delay.

The family all agreed that the deceased would have wanted to be buried near his father and mother in their home state. Is there any problem disinterring the body when the legalities have been taken care of and moving the and re-burying?

One should also inquire whether the original burial was done with a specific stipulation allowing for an option to remove the body once contact details are discovered.
