May an uncle babysit for his 3+ year old niece? I heard there is a leniency from Reb Moshe Feinstein.

 

A man over 13 years old may not babysit a girl over 3 years old.

One should not rely on the leniency mentioned by Reb Moishe. This is against סתימת כל הפוסקים והכרעת השולחן ערוך which makes no distinction between the generations. His position has been rejected by many contemporary poskim.

Furthermore, even Reb Moshe only writes not to protest against those who are lenient, but he doesn’t outright permit it. Additionally, his questions are negated if we accept that the concern is אונס קטנה and not פיתוי, as indicated in many poskim. Also, many poskim maintain that the man won’t be concerned about the fact that the תינוקת will disclose what happened.  Regardless, often it’s likely she won’t disclose to her parents what happened, due to fear of retribution, or other reasons.

ואף שבאג”מ אה”ע ח”ד סה, יב מחדש שבזה”ז יש מקום להקל, גם הוא עצמו לא כתב להקל בפועל כ”א ללמוד זכות למקילים ולהתיר בספיקו. והמנהג שקטנות אינן נישאות – לא נתחדש בימיו, ובימי השו”ע והנ”כ לא היו מוסרים קטנות בת ג’ לביאה כבימי הגמ’. ומ”מ חששו לאונס ופיתוי ולא חלקו והתירו בזה”ז. וראה שו״ת בצה״ח ב, נט. לב אברהם ק. מנחת איש א ע׳ לח. נט”ג הל’ יחוד פי”א הערה א.
